Legal & Ethical Issues in Substance Counseling

Workshop Overview

NOTE: Should the coronavirus lockdown extend into the summer months, then we will be conducting this seminar as a webinar using Go To Webinar. Should we switch, the webinar will occur on the same day and time as the live workshop (July 8, 2020). If you feel either of these formats works for you, then please feel free to register today!

This interactive workshop focuses on the major elements of legal and ethical issues surrounding counselors in working with patients who have substance use disorders. In this workshop, participants will learn about the different areas of legal and ethical concern for today’s counselors working with clients who have both mental health and substance use issues. Legal areas include scope of clinical practice, malpractice, duty to warn, direct and vicarious liability, informed consent, confidentiality, and working within the parameters of ADA. Ethical areas covered include workplace harassment, dual relationships, ethical decision making and common ethical issues reported by counselors. Differences in certain standards by different mental health and substance use professions will be discussed. Teaching methods include lecture, interactive exercises and group participation/discussion.

NOTE: New Jersey requires that mental health licensures (LCSW and LPC) require 5 hours in ethics training every two year cycle, and this course meets that need and is approved by both the ASWB and the NBCC. LCADCs/CADCs recently passed a rule adoption that they all must receive 3 hours in training on legal standards every two year cycle. This training meets this requirement also!

Course Objectives

  3. 3.Workshop participants will be able to list the three component parts to the definition of imminent danger.

  4. 4.Workshop participants will be able to list and describe four different common areas of ethical complaints against counselors.

  5. 5.Workshop participants will be able to identify three distinctions between 42-CFR-Part2 confidentiality exceptions and NJ HIV confidentiality exceptions.

  6. 6.Workshop participants will be able to identify at least two different theories of ethical decision making.

PARENTAL ADVISORY NOTICE: This Workshop Series Presenter runs a PG-13 Conference. Random cursing has occurred in the past. The presenter does his best to use outdated curse words that you have to Google to understand their meaning, like “tarnation” and “dagnabbit”. So, if you think a “muckspout couldn’t teach a hen to cluck” or if you find current curse words offensive … then DO NOT ATTEND!

DISCLAIMER: Management is cautioning that if offense occurs to you due to random (tier 2, not the really bad) curse words, then it is possible this is NOT the workshop for you. Caution! Presenter has sharp edges. This can be a very boisterous presentation. Laughing and learning has been shown to have certain side effects in less than 1% of the population. Side effects include professional confusion from laughing and learning, and mild to moderate irritability in some users. In rare instances it can lead to severe reactions, such as wanting to contact the authorities. If any of these have occurred previously, take immediate actions that may include, but not limited to, not attending this workshop/conference series! A good sense of humor is required in order to attend. You know your humor limitations; this presenter DOES NOT!

I have recommend this training to my colleagues, even if they are not pursuing the ACS, but are supervising clinicians in any capacity.” – August, 2024
